Robby Dee Photography – Terms and Conditions

(Applicable to Photography and Videography Services)

1. Application of Terms

These Terms and Conditions (“Terms”) apply to all contracts between Robby Dee Photography (“the Photographer/Videographer”) and the Client, to the exclusion of any other terms unless expressly agreed in writing by the Photographer/Videographer.

2. Management

Robby Dee Photography is managed by Me and You Event Group (“the Management”).

3. Copyright and Attribution

All photographs and video footage are protected under the Copyright, Designs and Patents Act 1988.

The Photographer/Videographer retains full and exclusive copyright in all images and videos.

The right to be identified as the author is asserted and should be credited as:
“Photography and Videography by Robby Dee Photography.”

4. Usage Rights and Exclusivity

The Client is granted an exclusive period to publish or release the commissioned photographs and/or videos as agreed in the contract.

The Photographer/Videographer reserves the right to use any material for advertising, portfolio, or promotional purposes.

After the exclusivity period, the Photographer/Videographer may license the material to third parties unless otherwise agreed in writing.

Editorial works may be offered to third parties post-initial publication, subject to prior agreement.

5. Licensing and Reproduction

Unless otherwise specified in a separate licence:
a. The Client is licensed to use commissioned photos and videos for marketing, PR, and editorial purposes (excluding paid advertising unless stated) indefinitely, on behalf of the original commissioning entity.
b. Any third-party publication of the material will incur an additional reproduction or usage fee.
c. Copyright remains fully with Robby Dee Photography at all times worldwide.

6. Videography Deliverables and Editing

The standard videography package includes one fully edited highlight film (typically 3–10 minutes) and, where agreed, additional full-length footage (e.g., ceremony, speeches, interviews).

Raw, unedited footage remains the property of Robby Dee Photography and will only be provided if agreed in writing and subject to an additional fee.

Video editing style and creative direction remain at the discretion of the Videographer.

Up to two rounds of minor revisions (such as adjustments to timing, music, or titles) are included unless otherwise stated in the contract.
Any additional changes or further rounds of revisions will be charged at the standard editing rate.

Final videos are delivered digitally (e.g., via password-protected download link or online gallery). Delivery times may vary depending on project scale but are typically within 6–8 weeks from the event date unless otherwise agreed.

7. Confidentiality

All information shared by the Client is treated as confidential and will not be disclosed to third parties except as necessary to complete the commission or where required by law.

8. Data Protection

Robby Dee Photography complies with the Data Protection Act and GDPR principles as outlined by the ICO. Personal data is handled securely and used solely for the purposes of fulfilling the commissioned work.

9. Client Responsibilities

The Client is responsible for:

  • Obtaining all necessary permissions and clearances for photography and videography (including location permits, model releases, and parental consent for individuals under 16).

  • Ensuring compliance with copyright and trademark laws.

The Photographer/Videographer accepts no liability for legal issues arising from the Client’s failure to obtain such permissions.

10. Payment Terms

Payment Due Date: Within 30 days of the invoice date unless otherwise stated.

Late Payment: Interest will be charged as per the Late Payment of Commercial Debts (Interest) Act 1998, plus 5% above the prevailing HSBC base rate from the first day after the due date.

Debt Recovery: Administrative charges of £15.50 + VAT per communication will apply for recovery actions. Directors of a company client shall be personally liable for outstanding fees.

Ownership of all photographs and videos remains with Robby Dee Photography until full payment (including any late fees) is received.

The Photographer/Videographer reserves the right to withhold delivery until payment is cleared.

11. Alterations and Extra Expenses

Any additional time, expenses, or changes to the original brief requested by the Client will be charged at standard rates and require prior approval.

12. Image and Video Availability

A minimum of 300 fully edited, high-resolution images will be provided (depending on the event).

The online gallery will remain accessible for 6 months from the commission date unless otherwise extended.

Edited video files will be available for digital download for 6 months following delivery.

13. Rejection Policy

Unless a specific rejection clause has been agreed, the Client may not reject the delivered photographs or videos based on artistic style or composition.

14. Force Majeure (Including Covid-19 Clause)

The Photographer/Videographer shall not be liable for failure to perform services due to circumstances beyond their control, including but not limited to illness, equipment failure, extreme weather, or restrictions due to Covid-19 or other pandemics.

15. Cancellation and Postponement Fees

A confirmed booking is considered firm. Cancellation or postponement will incur the following charges:

  • 10 working days’ notice: 25% of the fee

  • 5 working days’ notice: 50% of the fee

  • 48 hours’ notice: 75% of the fee

  • 24 hours or less: 100% of the fee

16. Governing Law

This Agreement is governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.

17. Amendments

These Terms may only be varied by mutual written agreement between the Photographer/Videographer and the Client.

18. Acceptance of Terms and Confirmation of Booking

By confirming a booking via email, message, or written correspondence, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

Email confirmation from the Client constitutes a legally binding agreement between the Client and Robby Dee Photography, equivalent to a signed contract.

A booking is not considered secured until written or electronic confirmation is received, and any agreed deposit (if applicable) has been paid.

Upon acceptance, these Terms and Conditions form the entire agreement between the parties, superseding any previous written or verbal discussions.

19. Deposits (if applicable)

A non-refundable deposit (amount specified in the booking confirmation) may be required to secure the date and services.

The remaining balance is payable in accordance with the payment terms outlined above.

Dates will not be held without receipt of the deposit where one is required.
